Please read these Terms of Service carefully before using KuikChat. By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use our services.
By accessing or using the KuikChat platform, website, or any associated services at www.kuikchat.online, you agree to be legally bound by these Terms of Service. These terms apply to all visitors, registered users, and businesses that access or use KuikChat in any capacity. If you are entering into these terms on behalf of a business or organisation, you represent that you have the authority to bind that entity to these terms. Your continued use of the platform constitutes ongoing acceptance of any updates we make to these terms.
KuikChat is a WhatsApp automation and customer relationship management (CRM) platform designed for businesses. Our services include WhatsApp chatbot configuration and deployment, a built-in CRM system for managing customer interactions, appointment booking via WhatsApp, automated reminders and follow-up message sequences, and an analytics dashboard for monitoring performance and engagement. KuikChat connects to the WhatsApp Business API through the official Meta Business API. The scope and features of your service access are determined by the plan agreed upon at the time of onboarding. We reserve the right to add, modify, or discontinue features with reasonable notice to active clients.
To use KuikChat, you must be at least 18 years of age. You must represent a legitimate, legally operating business that is authorised to use the WhatsApp Business API under Meta’s policies. By registering or using our services, you confirm that you meet these requirements. KuikChat reserves the right to refuse service to any individual or business that does not meet our eligibility criteria or that we determine, at our discretion, poses a risk to our platform, other users, or the integrity of WhatsApp Business communications. We do not knowingly provide services to individuals operating in violation of applicable law.
You are solely responsible for how you use the KuikChat platform and the messages you send through it. You agree to use KuikChat only for lawful, legitimate business communication purposes. You must not use the platform to send spam, unsolicited bulk messages, or any content that is illegal, fraudulent, misleading, abusive, or in violation of any applicable law or regulation. You are responsible for obtaining proper opt-in consent from your contacts before messaging them through any KuikChat-powered channel. You agree not to attempt to reverse-engineer, exploit, or circumvent any part of the KuikChat platform. You are responsible for maintaining the security and confidentiality of your account credentials, and you accept responsibility for all activity that occurs under your account.
KuikChat operates as a third-party service provider that connects to WhatsApp through Meta’s official WhatsApp Business API. By using KuikChat, you agree to comply fully with Meta’s WhatsApp Business Terms of Service, WhatsApp Business Policy, and any other applicable Meta platform policies, all of which are subject to change by Meta at any time. It is your responsibility to stay informed of and comply with these policies. KuikChat has no control over Meta’s policy decisions, enforcement actions, or platform changes. KuikChat is not responsible for any suspension, restriction, or termination of your WhatsApp Business Account by Meta, regardless of cause. Any disruption to your services resulting from Meta’s actions or policy enforcement is outside KuikChat’s control and does not entitle you to a refund or compensation.
Pricing for KuikChat services is agreed upon individually at the time of onboarding and is outlined in your service agreement or proposal. Payment terms, billing cycles, and included features are specific to each client engagement. All sales are final unless explicitly stated otherwise in your service agreement. KuikChat does not offer refunds for partial use of services, change of mind, or circumstances outside our control including but not limited to Meta account suspensions or disruptions to WhatsApp’s API. If you have a dispute regarding billing, you must notify us within 14 days of the relevant charge at info@kuikchat.online. We reserve the right to suspend access to the platform in the event of non-payment.
All intellectual property associated with KuikChat, including but not limited to the platform software, source code, architecture, design, branding, logo, written content, and proprietary automation systems, is owned exclusively by KuikChat. Nothing in these terms transfers any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable licence to access and use the KuikChat platform solely for your own business purposes during the term of your active subscription or service agreement. You may not copy, reproduce, distribute, create derivative works from, or commercially exploit any part of the KuikChat platform or its content without our express written permission.
To the fullest extent permitted by applicable law, KuikChat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of leads, loss of revenue, loss of business opportunities, or loss of data. This includes any damages arising from platform downtime, technical failures, disruptions to WhatsApp or Meta’s infrastructure, changes to Meta’s API or policies, or any other events beyond our reasonable control. KuikChat’s total liability to you for any claim arising from or related to our services shall not exceed the amount you paid to KuikChat in the 30 days immediately preceding the event giving rise to the claim. You acknowledge that these limitations are a fundamental element of the agreement between you and KuikChat, without which we would not provide the services.
KuikChat reserves the right to suspend or permanently terminate your access to the platform at any time, with or without prior notice, if we determine that you have violated these Terms of Service, Meta’s WhatsApp Business Policies, or any applicable law. We may also terminate access if your use of the platform poses a risk to other users, our infrastructure, or the reputation of KuikChat. Upon termination, your right to access and use the platform ceases immediately. You may request termination of your own account at any time by contacting us at info@kuikchat.online. Termination does not entitle you to a refund of any amounts already paid. Provisions of these terms that by their nature should survive termination will remain in effect.
These Terms of Service are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these terms or your use of KuikChat shall be subject to the exclusive jurisdiction of the courts of Pakistan. If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
